Terms and Conditions of Use

Welcome to Hang Loose Rentals, LLC (Hang Loose) where our motto is “Get Busy Living”.  We are excited for you to embark on the adventure of the open water, whether that is the Pontoon boat, the Paddle Boards, or a smooth ride in a Kayak.  We want you to have the best time during your adventure without surprises. All renters will be subject to the terms and conditions indicated below. Please read them carefully prior to accepting the terms and conditions.

Definitions

“Qualified operator” means a person with a valid boater’s certification if born after January 1, 1989 or valid driver’s license if born before January 1, 1989, who is not under the influence of drugs or alcohol, has passed the applicable Hang Loose operator instructions for the watercraft rented and can prove their ability to handle the watercraft as the operator.

Watercraft Descriptions

The watercraft rentals are available as described on this site. The pictures representing these rentals are factory pictures of the rentals available and may have slight variations or may be available in colors other than the one pictured. Please review the descriptions carefully when making your selections to ensure you rent the best watercraft option for your adventure.

General Use Information

Although we cannot mention everything that should not be done while operating or as a passenger of a watercraft rental, a few key rules to maintain safety for our renters, operators, and passengers we require include:

Boat Education and Safety – All boat renters/operators must be 21 years or older. Wisconsin (WI) law requires renters and/or operators with birthdays AFTER January 1, 1989, to have a valid WI Boater’s Certificate.  Boating Certification must be completed PRIOR to the day of the rental.  Failure to complete the Boater’s Certification can result in a cancellation of the rental or require that the rental/operator for the rental be assigned to a certified individual.  Boat renters/operators born BEFORE January 1, 1989 must have a valid driver’s license.

Hang Loose Rentals wants your experience to be fantastic, not frightening, nor unsafe.  For this reason, all renter/operators must complete the boat instruction provided by Hang Loose at no additional cost to the renter/operator prior to operating or towing one of our rentals. Failure of the operator to pass the instruction provided, will require reassignment of the operator to another qualified operator, securing an authorized operator through Hang Loose Rentals, (additional fees would apply), or in the event a certified operator cannot be obtained, the rental would be cancelled, and a full refund would be issued.

Person safety is our main concern at Hang Loose Rentals, but we also want to be sure our rentals are kept clean, used safely, and returned in one piece. We expect all users and passengers to ensure precautions are taken when towing, docking, unloading, or loading as well as operating the watercraft.  Securing the boat for towing, docking, use of the boat fenders to protect the boat during passenger boarding and exiting the watercraft are few of these required safety measures. 

Coast Guard approved life jackets are available with each rental, however, not all sizes are represented in abundance. It is recommended to verify the size needed ahead of the rental or bring the life jacket(s) needed on the day of the rental to ensure the life jacket is the best size.  All passengers 13 and under MUST wear a Coast Guard approved life jacket to ride in the Pontoon.  

The renter / operator is responsible for all passengers, their activities and the enforcement of these terms and conditions.

Delivery/Towing – Hang Loose will deliver the watercraft as specified under “Our Rentals” on the home page of this site.  If the renter will be towing the watercraft to their destination, the towing vehicle must have the proper trailer adapters to ensure the lights and blinkers work properly.    

Prohibited Activities – All illegal activities are prohibited from occurring while towing, docking, operating, or riding the watercraft rental(s). This includes illegal substance use or activity such as buying, selling, or using of such illegal substances. Any form of illegal activity would be considered grounds for immediate cancellation of the rental without a refund. 

Alcohol Consumption – The operation of a watercraft in Wisconsin follows the same drinking and driving laws as would the operation of a vehicle. If your Blood Alcohol Level is .08 percent or higher, you can be charged with intoxicated boating. Whether you are a resident of Wisconsin or a visitor, the drinking and driving laws of Wisconsin will apply to the operator of the boat on a Wisconsin waterway.  Operation of a boat while intoxicated poses danger to everyone on the waterway. If alcohol will be consumed while using the watercraft, Hang Loose Rentals strongly encourages those who decide to drink to drink responsibly and that, before departing with the rental, you designate a qualified operator who will not drink alcohol as the designated driver of the watercraft.

Hang Loose Rentals will exercise the right to refuse to rent the watercraft to any operator that is intoxicated or under the influence of abusive substances without refund. Ability to reschedule will be at the discretion of the Hang Loose Rental Representative.

Pricing

Please refer to the Scheduling or Merchandise page of this website for pricing information for rental and Merchandise.  Pricing indicated on this site represents the cost of the rental or purchase but may exclude taxes, surcharges, or any other costs.   Pricing is subject to change at the discretion of Hang Loose Rentals. Once a rental has been confirmed with full payment, pricing will be locked in and will not be increased for that rental.

Late Returns

Rentals must be returned on time of the duration of their rental. The renter is subject to pay a full day’s rental price of the unit that they are renting if returned late.

Payment Terms

Payment in full is expected at the time of scheduling. Payment in full secures the date and time for the rental selected. 

 

 

Cancellations

Life gets busy, plans may change. At Hang Loose, cancellations can be done via the website or by contacting Hang Loose Rentals at 920-362-6213. Our policy for cancellations is as follows:

  • Cancellations made more than 48 hours in advance of the rental date will receive a full refund (Minus non-refundable 4% booking fee);

  • Cancellations made 48 hours or less will not receive a refund, however, the rental can be rescheduled based on availability for a later date not to exceed 18 months from the original date.

  • No show, no call for a rental will result in forfeiture of the entire rental fee.

  • If adverse weather conditions prohibit the renter from enjoying their rental, the renter will receive the option to rebook the rental or receive a full refund. Adverse weather conditions that will prohibit the rental will be determined solely by Hang Loose Rental.

Right of Refusal

“Get Busy Living”, that’s the motto of Hang Loose Rental. To ensure we are all living our best lives, Hang Loose Rentals reserves the right to refuse rentals to anyone that poses a threat of harm and safety to themselves, others or to any watercraft (pontoon, kayaks, SUPs) or other property owned or maintained by Hang Loose Rentals or any representatives of Hang Loose Rental.  This includes, but is not limited to, individuals that:

  1. Are under the influence of drugs and/or alcohol;

  2. Do not have the required certification or license to operate a watercraft; or

  3. The Hang Loose Representative believes may not be able to operate the watercraft safely

Weather can play a factor in safe boating.  Hang Loose reserves the right to refuse to rent a watercraft if it deems weather conditions are adverse enough to affect the safety of the renters or potentially damage the watercraft.

Merchandise

The merchandise listed on the site will be subject to availability, vendor production and delivery.

Privacy Policy

Information that you provide or that we collect about you through your access to and use of the Site is subject to our Privacy Policy, the terms of which are hereby incorporated into these Terms by reference. We encourage you to read and become familiar with our privacy practices, as described in our Privacy Policy.

 

Links to Other Websites

For your convenience, Hang Loose Rentals may provide hyperlinks on our website to other sites such as potential VRBO and Airbnb rentals, boating education or certifications, and local establishments for food and drinks.  None of these companies whose links appears on our website are controlled by Hang Loose Rentals.  We do not hold an affiliation to the businesses presented, nor do we endorse or sponsor such websites. We are not responsible for the availability, accuracy, content, or any other aspect of such websites.  Hang Loose Rentals disclaims all liability for such websites, for all access to and use thereof, and for the use of the links to such websites.  We also disclaim all liability and make no representations or warranties with respect to any products or services made available, sold, or provided to you by any third-party.  Your use of other websites and decision to purchase products or services from one of those companies is your responsibility and subject to any terms and conditions located on that third-party company’s website, as well as the privacy statement/notice/policy of that third-party company.
